The short answer is "yes".  the reality is that it's unlikely to go to jail if this is your first arrest for DUI/DWI but it is certainly possible.  This is especially true if there was an accident, you were well over the legal limit, if you refused the breathalyzer, if you were driving with a suspended license, or you had a minor in the vehicle.
