Asked in Seguin, TX Last answered on October 28, 2026

Fatal accident 4 years ago. I was charged with manslaughter. Never given a ticket. Other driver had no insurance, recently underwent open heart surgery, no DL, talking on a cell phone at the time of the accident. Lawyer is court apptointed and has done nothing to help. Just keeps saying to take the plea deal.

Four years is a long time, and the frustration makes sense. Because you have a lawyer, I can't second-guess what that lawyer is doing in your case, but I can explain how the system works.

The decision to take a plea belongs to you, not to your lawyer. A good lawyer explains the offer and the risks, and then you decide. You are also entitled to a lawyer who looks into the case. Things like the other driver's phone use, license, and medical condition are the kind of facts a lawyer is expected to investigate when a manslaughter charge depends on whether the defendant caused the crash.

You do not get to pick a court-appointed lawyer, but you can ask the judge in writing to appoint a different one, and you will need to explain why. You can also hire your own lawyer, who can take over the case. Complaints about a lawyer's conduct can go to the State Bar of Texas grievance process.

Keep every court date, and keep the facts of the case between you and your lawyer.

So sorry you are going through this.  Ask Judge to appoint you a new lawyer.  Or go hire a better lawyer.
