The rule of thumb is whenever you believe you could be charged with a crime, you should not speak to law enforcement until you first consult with a criminal defense attorney. You will not know what to say or what not to say. For instance, intentionally lying to police could result in misdemeanor criminal charges. More problematically, an admission of guilt or a false statement could be used to convict you of serious felony charges if the crime occurred in Wisconsin such as Fleeing/Eluding An Officer and/or Second Degree Reckless Endangerment of Safety. Once you consult with a criminal defense attorney, you'll be in a better position to know if it is in your best interest to make a statement to police. In cases like this, lawyers often do not recommend you make a statement to police but it depends on the facts of each case, which is why it's important to consult with a criminal lawyer as soon as you can.
