Is it possible to "ask for full custody"? I am the aunt. The father is abusing his child. He knows I have evidence

I am the Aunt. My brother's grandchild is being abused. I filed the latest CPS report. My brother will take his grandchild and is capable. I would be the child's caregiver because the child needs full-time care. Question is, can I ask the father for full custody without a long drawn-out court battle? There is mounting evidence of the abuse. Hospital records, CPS records, and my personal documentation. My niece was very close to winning CPS case, but, CPS said she was coaching or coercing during a therapy session. She is not involved much at this time.

It is possible to be granted custody through a “3rd party” custody action.  However, you must meet certain requirements to be able to ask a judge for legal custody of your niece.  The biological dad, may voluntarily grant you temporary custody and care through a Delegation of Parental Authority. )DOPA) That is a short form that you and he can fill out and have signed in front of a notary.  Other parent has to be notified. This doesn’t award you any child support.  It is in place for one year.
