Toddler’s father has history of drug abuse and he is now seeking custody. Odds of 50/50 or more?
Asked in Medina, OH on April 9, 2026 Last answered on April 15, 2026My toddler’s dad & I were never married. He has a history of drug abuse and has not lived with us for almost 1 year, after discovering drugs in the playpen & crib. He admits to drug abuse. He passed 1 hair follicle test recently and is now pushing for “at least” 50/50, but “ideally” full-custody. I have been the primary parent since birth & have handled every aspect of the child’s life. We live in different counties (adjacent). Dad has supervised visitation and is attempting to be involved since court dates have been scheduled. What is likely to happen with custody?

Based upon these facts, it would be highly unlikely that Father would receive sole custody, shared parenting or 50/50 parenting time. There certaily were some significant safety concerns about Father's ability to care for the toddler. There are some unknown factors which will also be relevant. What treatment has Father sought and how long father has been "sober" prior to any trial of this matter. Is Father working and otherwise in a stable situation? Further, what if any parenting concerns does Mother have. Does she have a history of drug and alcohol abuse or any criminal record. The actions that both parties take in the 12 months immediately preceding any custody trial will likely have a significant impact on the outcome of this case.
