is cheating husband who left the home, but makes all $, req'd to pay mortgage and bills?

I discovered my husbands affair for about a year. he was cheating with his secretary and may get fired if this gets out to the people above him or HR. He is out of the house. So my two kids and i are home. they are 12 and 15. He makes all the money and i do not have anything - i am scared about securing ourselves in the home and filing for divorce. is he required to continue paying the mortgage and bills?

Not necessarily. The cheating will likely not be a big factor in determining whether the husband is required to pay marital bills. However, the funds taken out of any accounts could be treated as marital, and a motion could be filed for the return and use of those funds. I would consider hiring an attorney and filing an ex-parte Motion on the issue of return of the funds, then an emergency motion on the issue of spousal support.
