What should I do if I am being retaliated against at work?

Asked in New York, NY on March 10, 2025 Last answered on March 11, 2025

I’m a nurse who reported some unsafe practices at my hospital, and since then, I’ve been facing retaliation from my employer. This includes being assigned less favorable shifts and receiving negative performance reviews. I’m considering legal action and need to know what my options are.

It can be unlawful to retaliate against an employee who reports unsafe practices depending on the state and what exactly the unsafe practices are that you reported. Retaliation can come in the form of less favorable shifts, negative performance reviews and loss of other employment benefits.  More information is needed, though, but you can continue to complain and hope someone responds appropriately.  Before doing anything, you should probably speak with an experienced employment attorney who is licensed to practice in your state to get a full understanding of what is happening and what can be done.
