Can you bring a claim in Florida to challenge wrongdoing by a trustee or executor?

Claims against a trustee or personal representative generally require the filing of a lawsuit or other adversary proceeding. In most cases, such actions are brought within the probate court, and, with respect to trusts, as a trust action in the probate division. A trusts and estates litigation attorney is best suited to evaluate the specific facts of the matter, advise whether a viable legal claim exists against the fiduciary, and recommend the appropriate course of action.
