Maryland custody decisions are based on the “best interests of the child” factors. You can find them in:

  • Maryland Code, Family Law Article (esp. §§ 9-101 et seq., addressing custody and visitation, safety, and abuse), and
  • Maryland appellate case law explaining the best-interest factors (for example, Taylor v. Taylor and Sanders v. Sanders).

The Maryland Judiciary’s Parenting Plan Instructions also list these factors in plain language. The court decides two key things in a custody case: (1) how to make legal custody welfare decisions regarding medical, education and religion, and (2) where the child or children will primarily reside and under what custody schedule.
