As a law firm that works routinely on business formation, growth and intellectual property in California, we see a lot of confusion around brand protection. The key point is that forming filing a DBA, publishing a website or forming an LLC or corporation, does not automatically protect your business trade name as a brand. It may only prevents others from registering the same entity name with the state.

Trademark rights come from use in commerce. If you are using a name or logo to identify your goods or services, you may already have common law trademark rights. These arise automatically and cost nothing. The benefit of common law protection is that it exists without filing. The downside is that it is limited to the geographic area where you actually do business and can be difficult to prove or enforce. It also does not stop someone elsewhere from registering the same or a similar mark and gaining stronger rights.

To strengthen IP and brand protection, you can register a trademark. For the strongest protection, federal trademark registration through the United States Patent and Trademark Office is usually the best option. Federal registration provides nationwide priority, creates a presumption of ownership, and makes enforcement far easier, especially online. It also adds real value to the business for investors and partners.

Before registering, a proper clearance search is critical. Many problems arise from skipping this step and discovering conflicts after money has been spent building a brand and starting the legal process for the trademark filing.

In practice, common law rights may be enough for small local businesses. Registration becomes important as soon as growth, fundraising, or expansion is part of the plan.
