I am very sorry if you, a loved one, family member or friend has experienced a birth injury or the effects of one. Birth injuries can occur in a variety of ways, including in utero, during labor and delivery and after. It is critical to speak with a lawyer who specializes in this area as it is one of the most complicated areas of law and medicine. A parent can bring a claim on behalf of a child who suffered a birth injury, but they may also have their own claim(s) for the effect the injury to a child has had on them. A mother who is injured during pregnancy, labor and/or delivery can bring their own claim as well.
If a birth injury was caused by the negligence or malpractice of a person, medical provider, or unsafe product (or any other responsible party) the parents may have a right to seek compensation on behalf of the injured child for the damages caused. These damages include past and future medical treatment and past and future pain and suffering.
