Birth injuries can occur in a variety of ways, including in utero, during labor and delivery and after. If a birth injury was caused by the negligence or malpractice of a person, medical provider, or unsafe product (or any other responsible party) the parents may have a right to seek compensation on behalf of the injured child for the damages caused. These damages include past and future medical treatment and past and future pain and suffering.
