Should I have a lawyer representing me?

Asked in San Francisco, CA Last answered on October 27, 2026

I was back-ended in my car by a speeder. Both insurance companies agree the other party was responsible. I spent 5 days in the hospital (3 days in the ICU with rib and sternal fractures and resultant atrial fibrillation. The other party had only the minimal insurance required by law. My car was totaled. My insurance says I will only get $25,000 for medical, and that benefit will be applied to any medical bills. Reimbursement for my car is pending because the other insurance says they may have me pay part of the property damage. (Was catapulted into a building). I did not have collision. I am 84 years old; I've never had an accident. It will take me months to get my strength back. Is this a viable case for an attorney? My hospital bill was over $135,000. How does Medicare fit into this?

While it is possible to handle a claim by yourself, it is a bit like acting as your own doctor, or general contractor. Yuo may save on professional fees, but end up worse off or not as well as you would have if you had professional help. Sounds like you have some significant losses and need full compensation. An insurance company cannot be trusted to treat you fairly.
