I want to fight DL suspension that was given to me after a vehicle I no longer owned was in an accident.

Asked in Hutchinson, KS on May 23, 2026 Last answered on June 16, 2026

I got a divorce and a restraining order from an abusive partner. He was awarded a truck that was registered in my name. He failed to register it or insure it. He then let his minor son drive it with another minor. He wrecked it, now my DL is suspended unless I can personally get my abuser and the guardian of the other minor, whom I do not know, to sign a release of liability. This is not possible for many reasons. I want to challenge my suspension, but I need to know how.

It's a very difficult situation you are in without an easy answer.  We've helped clients deal with this by filing declaratory actions in District Court, forcing Kansas to reinstate the driver's license.  There's also an option to file a lawsuit involving all the relevant parties, and then getting resolution and a release.  Either way, it would likely require litigation.  It could cause the parties to see the writing on the wall and give you what you need (releases) that you could then provide to Kansas in order to get your license back.
