What legal action can I take if I feel a Kentucky nursing home or assisted living center is not taking adequate care of my loved one?

You should consult an attorney who has handled a large volume of nursing home cases first. That attorney should be prepared to review the public information about the facility (e.g., Medicare 5-Star Ratings, state survey results, etc.) and obtain your loved one's medical records from the facility (and, if applicable, also from any hospital to which your loved one was discharged after suffering a bad outcome at the nursing home). The facility's records should contain a wealth of information regarding why your loved one is not receiving adequate care (e.g., whether the facility failed to properly assess your loved one's individual medical needs and/or failed to create an appropriate care plan that is specifically tailored to meet your loved one's needs). There are a number of state and federal rules and regulations that each nursing home is required to follow. The medical records, when properly analyzed by an experience nursing home attorney and the appropriate medical experts, should reveal whether the facility failed to follow the state and federal rules and regulations.
