Can I sue my neighbor for injuries from their tree limb that fell?

Asked in New York, NY on March 10, 2025 Last answered on February 4, 2026

I was injured by a falling tree branch on my neighbor's property. It had been hanging over the property over a walkway we share. It needed to be removed for a few weeks after a storm that must have knocked it down. My neighbor was aware of the dead tree branches but did not take any action to remove them after I complained.

In order to give you a definitive answer there are further details needed however generally If they had prior notice of the dangerous condition then you may be able to bring a claim for injuries.  If you are injured, treating and would like to bring a claim give us a call.

You can.  I have pursued simliar cases, and trees are like any other structure - they should be properly maintained in a non negligent way.  You should contact a person injury lawyer to figure out next steps.  These are difficult and technical cases to litigate.  Most experienced personal injry lawyers offer free consultations and will review your case without charging you any money unless a lawsuit is filed and you recover money.  I am not sure of the timing here, but I would recommend calling a lawyer quickly because if you wait too long, the remnants of the tree may be disposed of.  You want to make sure that it gets preserved.
