Can I sue a funeral home for cremating my father without my consent?
Asked in Dallas, TX on December 10, 2025 Last answered on March 2, 2026My father was cremated without my consent or knowledge. His roommate authorized this. From my understanding in Arkansas, the funeral home is responsible for obtaining proper authorization. Yes, they knew my father had children. I live 4 miles from the funeral home. They never tried to contact me regarding this. What attorney do I need?

Yes, you can bring a claim against a funeral home for cremating the remains of your loved one, if there was no request or consent. Typically, this type of claim has a two year statute of limitations.

You may have legal options, but the answer depends heavily on the specific facts and the laws in your state. In many places, funeral homes must follow strict authorization procedures before cremation, and failing to obtain proper consent can lead to claims such as negligence, breach of contract, or violation of funeral service regulations. However, whether you can successfully sue—and what damages might be available—requires a careful review of who had the legal right to authorize the cremation, what documents were signed, and how the funeral home handled the process. To understand your rights and next steps, contact Bennett Legal.
