My PI attorneys won't release my uncontested portion of the settlement funds, unless I waive my right to contest fees
Asked in Elmendorf, TX on September 3, 2026 Last answered on October 2, 2026It's been about 4 months since my case settled, and my attorneys won't release my portion of the funds, contingent that I sign a full release of the distribution. How can I get them to release the funds without waiving my rights to contest any fees? Is this normal?

I am sorry you are experiencing this problem with your attorney. I do not know enough facts to fully analyze your situation and your possible remedies. There are so many scenarios that come to mind and without knowing the entire facts, it is impossible for me to comment as to what is happening. I would highly recommend that you contact the State Bar of Texas Client-Attorney Assistance Program (CAAP). It is there to help resolve these types of disputes. You can learn more about what it can do to assist by going to the State Bar of Texas Attorney-Client Assistance Program site. I cannot give you the link on this answer but you can do a search and find the information quickly.
I wish you the best and hope this will help.
