How can someone get charged with an F3 charge for fleeing the police when they never caught the suspect actually driving
Asked in Georgetown, OH on March 2, 2026 Last answered on April 1, 2026My friend was charged for the F3 fleeing and eluding police, only from his association to the car that was running from the police. They never stopped the car or got a visual of the driver, but since he is associated to that car by his girlfriend and his past record of that same charge, which he was guilty of, they are trying to send him to prison.

To be convicted of failure to comply, the prosecution has to prove beyond a reasonable doubt that the accused was the driver at the time of fleeing. The connection of the defendant to the vehicle, standing alone, is not nearly enough for a conviction. With no visual, no admissions, the case is very weak. Association with the car and past record is not enough.
