I was involved in a hit-and-run accident. The at-fault driver fled the scene and was not identified. Claims have been ongoing. What are my next steps?
Asked in Manassas, VA | January 28, 2026I was involved in a hit-and-run accident. The at-fault driver fled the scene and was not identified. Police reports were delayed, contributing to claim processing delays. My vehicle was totaled as a result of the accident. I was transported by ambulance to the ER on the date of the accident, followed up with my primary care physician a few days later. Doctor documented ongoing pain and recommended physical therapy.
I was unable to start physical therapy due to delays in claim processing and confirmation of coverage. I continue to experience pain and physical limitations. ER and ambulance medical bills remain unpaid and have gone to collections, impacting my credit. Expenses have not yet been reimbursed and were referred to a separate property damage adjuster.
Claim has been ongoing for nearly six months with no settlement. Insurer requested FOIA records from two police departments; delays were outside my control. Insurer recently confirmed uninsured motorist coverage applies. I have been asked to complete medical and wage authorizations; insurer states evaluation will take an additional 1–4 months after records are collected. How can a lawyer help me with next steps?
