Answer

This question is very fact sensitive. Must be determined when the injury most likely occurred. The prenatal medical records must be reviewed , as well as the delivery records and the postnatal records. Based on the opinions of retained medical experts we must establish if there was a deviation from the accept standard of medical care and further whether or not the deviations were the cause of the injury. Same will require thorough review of all noted medical records and experts in several different specialities.
