Car accident and I received a DUI. My insurance had lapsed.

Car accident on July 22nd, I received a DUI. My insurance had lapsed as well. But I wasn't at fault; the tractor-trailer ran me off into the guard rail. He was carrying an oversized load, and his follower wasn't right behind him. I have a witness who was following me, and another witness who stopped. I spoke with the insurance company before I put myself into rehab, and the lady I spoke with stated the driver admitted it was his fault. Now they don't want to produce the phone conversation and want me to pay $35,000, and the police report says their estimated damage was $120.00, and mine was 15,000. I know I was intoxicated, but do remember.
