Employers, fiduciaries, insurance companies, and ERISA plans themselves can be sued under ERISA throughout the nation.  In Georgia, it is relatively common for an employee to sue the insurance company responsible for providing insurance benefits through his/her employer’s plan. 

For instance, if your health insurer denies your claim for medical benefits, you may find yourself needing an ERISA litigation attorney to recoup those benefits.  It is also common for individuals to sue their employer that sponsors the benefit plans if something goes wrong. Most lawyers can recognize an ERISA litigation matter when they see it, but few practice in this area regularly.
