Father of daughter is taking me to court for paternity test and owes back child support. What are my options?
Asked in New Haven, IN on January 5, 2026 Last answered on February 4, 2026Father has been in jails & prisons most of her life. He is trying to get out of paying back child support. Now I & my daughter have to take off work to get test done and pay for it. This has been going on too long. What are my options?

If paternity was already established by paternity affidavit (document signed at the hospital) or through a court order (when the child support order was issued) and the time to challenge both of those has passed, you could argue that requesting a DNA/paternity test is not relevant as he is "Father" in the eyes of the law. Each county in Indiana has a child support division through the prosecutor's office and you can sign up for free services (called "IV-D services") for enforcement of the current child support order and to get additional support payments towards any accrued arrearage (back child support).
