city code enforcement is harassing me with violations in which the city is culpable of wrongdoing with flood control
Asked in Hesperia, CA on March 24, 2026 Last answered on April 19, 2026The city of Hesperia has a flood problem throughout the city, especially where my property is located. The last storm happened in December 2025. Flood waters and tons of dirt entered my private property, and they want the dirt removed at my own expense. I'm tired of getting harassed by these code enforcement letters and public nuisance notices. So far, I've paid $2750.00, and the city is still not satisfied with the job.

Flooding has been a problem throughout California and is a complex issue.
The following is not intended as a legal response to your issue, but rather to provide a general guidance outline for your information. The initial facts to determine are: (i) source of the water flooding your property and (ii) as to that source, who is responsible for maintaining the facility or the land. (iii) Are there any conditions, building or landscape for example, on your property or neighboring property which contributes to the flooding of your property. The responsible party for maintenance information is generally found on the approved development plans and subsequent recorded documents, if any. After those basic facts are determined, the City ordinances and regulations need to be reviewed.
