My mother suffered a stroke due to a blood clot from her leg that stemmed from a misdiagnosed stomach cancer which had metastasized to her liver. The cancer was an incidental finding from a CT scan that was done when she was admitted to the hospital for the stroke. The CT scan was done because after blood work, she was noted to have a hemoglobin of 5 and Doctor wanted to see if she had a bleed somewhere.

this sounds as if it is a valid case---however, must have an MD review and agree to come forward and testify before it can be filed--and the statute of limitations is 3 years from the time of the event
