Do I have to pay a leasing administration fee for a house I’m already buying for my brother?

The authority to impose assessments, charges, and other fees for homeowner and condominium associations is typically established in the community's recorded declaration. The Georgia Condominium Act and Property Owners' Association Act, along with many declarations, authorize associations to assess common expenses that benefit less than all lots or units to only those lots for units benefited. It is typical for an association's assessment article and/or leasing restrictions to authorize levying common expenses for services and items provided to some, but not all, owners against only those benefited owners. Governing documents may also specifically provide for a leasing administration fee or uniform charge for lots or units eligible to lease, to cover the association's cost for services benefitting those eligible owners. Common services include, but are not limited to, updating association records regarding occupancy, processing related forms, issuing parking passes and registrations, providing additional documents, and move-in/move-out fees. This process helps ensure that only the owners who benefit from these increased association expenses bear responsibility for them.
