Complicated situation - how do i get a home in my name when the homeowner is being sued for non payment of the mortgage?
Asked in Blaine, MN Last answered on October 22, 2026My fiance is being sued for non payment of the mortgage. I am not the homeowner. I dont want myself and my children to end up homeless because of this. Is there a way to get the house in my name? Or would have to sell it to me? We have talked about this and he is on board.

In Minnesota, real property is transferred by deed. The property owner can deed the property to another person. However, mortgages are not satisfied unless paid when a property is transferred. The act of transferring the property does not satisfy the mortgage.
