Help me with a civil matter that involves my daughter, who was molested

Asked in Evansville, IN on March 12, 2026 Last answered on June 29, 2026

My daughter was molested at 6 years old, and the person has since been tried, convicted and sentenced to 30 years in IDOC. also his wife is charged with neglect, as her granddaughter reported it to her that he touched her and she did not report it to the proper people. had she reported it, it very likely would not have happened to my daughter. Do I also have a civil case?

I am very sorry that happened to your daughter.  I am glad to hear the perpetrator was convicted.  You would likely be able to pursue a civil case on behalf of your daughter under those circumstances. However, the more important question would likely be whether there is a liable defendant who has sufficient funds to pay for a judgment or settlement.  Our firm often handles these types of cases where the perpetrator was acting within the scope of their employment when the assault occurred (for example, a medical provider, school employee, etc.). If you would like to discuss further, you may reach out to our firm directly.
