My wife has used my immigration status as leverage to control custody decisions and force me into an unconscionable financial agreement. FACTS: Immigration Coercion: Wife filed I-130 green card petition for me, then used it as leverage Threatened to cancel petition unless I signed unfavorable post-nuptial agreement Recently attempted to cancel my I-130 in retaliation for requesting custody Have recordings of explicit immigration threats Post-Nup Under Duress: Signed December 2023 while separated from children and financially dependent Agreement gives her $2.5M in assets, leaves me with -$84K in debt My own attorney documented it was a "great disadvantage" before I signed I wrote at time of signing: "I have no other option to be able to live close to my kids" Wife's attorney admitted in writing she avoided discussing custody during post-nup negotiations because it would "weaken the enforceability of said agreement" Financial Disparity: She controls $500K+ in liquid assets She unilaterally drained joint accounts across three countries (US, Ind & Fra)I have zero access to community funds.

How do I protect my retirement in a divorce when I earn more?
Asked in Vacaville, CA | June 5, 2026Ending a 24-year/17yr marriage, due to infidelity from his side. I earn more, I am a registered nurse. He works part-time with full capacity to work full-time. We could both want an uncontested divorce, but I am unsure of his personal concerns, which may be money. I want to protect my retirement. Our children will be cared for by both of us.

Asked in San Jose, CA | April 28, 2026I am a stay-at-home mother who has been caring for the kids for approximately 10 years. My husband and I have been married for 12 years with two small children, ages 6 and 9. He abandoned the home at the end of February and only infrequently provides me with funds. He routinely forwards me utility bills, knowing I have no income. He said he will take all of the utilities out of his name. He has threatened to take full custody of my children because I am without a job. His income is $615,000; however, he structured his paycheck in a way that he only brings home 6,000 every two weeks. He invests the rest. I have no access to any funds other than what is in the joint bank account. I asked my lawyer to file for a temporary. He has been incredibly financially and psychologically abusive since I became a stay-at-home mom. He has also yelled at me several times and has pushed me on occasion.
